How to Use AI in Advertising and Marketing: Guidelines for Creatives and Businesses

The Ministry of Digital Transformation, in collaboration with industry experts, has developed guidelines for the responsible use of AI in advertising and marketing. These recomendations are designed to help creatives and small businesses to work with innovative tools while minimizing risks to themselves and their clients.

An increasing number of creatives are using artificial intelligence to promote products and services. Some companies and startups are turning AI tools, such as ChatGPT and Midjourney, into copywriters and designers, fully trusting them to create promos. However, not all AI tools are safe. AI systems can collect personal data from your target audience, generate biased content and manipulate the promotion of your product on websites and social media. In developed recommendations, we provide specific advice on how to mitigate these risks and use AI to its fullest potential,

said Oleksandr Borniakov, Yeahuty Minister of Digital Transformation.

The document compiles advice on how to enhance the effectiveness of advertising and marketing communications using AI without misleading consumers or violating advertising regulations.

Among the recommendations are controlling the data you share with AI systems, avoiding the dissemination of personal data from your target audience, labeling AI-generated content, and not delegating 100% of advertising creation to artificial intelligence.

The appendix contains instructions with checklists on what to look for when choosing an AI tool and how to assess whether the generated content violates consumer rights.

The development of these recommendations involved experts from specialized associations and state institutions, including the Expert Advisory Committee on AI Development under the Ministry of Digital Transformation, the IT Ukraine Association, the Interactive Advertising Bureau of Ukraine, the All-Ukrainian Advertising Coalition, the Ukrainian Marketing Association, the Ukrainian Bar Association, the National Council of Ukraine on Television and Radio Broadcasting and the State Service of Ukraine on Food Safety and Consumer Protection.

The recommendations for the responsible use of AI in advertising and marketing are one of the tools that the government will provide to businesses to prepare for the future regulation of artificial intelligence in Ukraine. The full list of tools can be found in the White Paper on AI Regulation in Ukraine.

These guidelines were developed with the support provided by the United States Agency for International Development (USAID) through the USAID Cybersecurity of Ukraine’s Critical Infrastructure Project and the Digital Transformation Support Project with the support of USAID and UK Dev.
