The government has simplified immigration of foreign IT-specialists

On March 11, 2020, the Cabinet of Ministers of Ukraine adopted Order № 431-r “On Establishing an Immigration Quota for 2020”, which established a quota of 5,000 people of highly qualified specialists. After analyzing the situation with the use of this category of quotas, the IT Ukraine Association and BRDO developed proposals to improve this mechanism by amending Order № 283 of March 19, 2020. The relevant letter with proposals of the IT Ukraine Association was sent to the Ministry of Economy, Trade and Agriculture of Ukraine on September 4, 2020.

According to the letter, the Ministry issued Order № 1847 of September 21, 2020 “On Amendments to the List of Specialties and Qualification Requirements for Specialists and Workers Whose Need Can Be Satisfied by Immigration in 2020.”

Amendments to Order № 283 provide:
  • expanding the list of occupations covered by the immigration quota for highly qualified specialists (23 professions, in contrast to the previous version of the order, which included 10 professions), as well as categorization and setting the appropriate quota for each category of professions: programmers (3000 people), computer specialists (800 people), managers (500 people), information security specialists (300 people), analysts (200 people), managers (100 people), information processing and software operators (100 people) ;
  • confirmation of work experience, which will be carried out by one or a combination of such documents as the employee’s employment record book or its analogs; letters of recommendation confirming the provision of services in the relevant field; contracts for the provision of services and acts of acceptance of services provided in the relevant field; other documents confirming work experience issued in the applicant’s country of residence;
  • setting mandatory and additional requirements for the experience of the specialist. The mandatory requirement of confirmed work experience must be supplemented by at least one of the additional requirements: the amount of income by profession for the previous calendar year, the availability of higher specialized education, the availability of world-renowned certificates;
  • reduction of the mandatory requirement for confirmed work experience to 3 years (previously such experience should have been at least 7 years).
