A new system of employment of CIS citizens will start shortly

Kyiv, August 27 – The text of the Resolution of the Cabinet of Ministers of Ukraine No. 651 dated July 18, 2018, which amends paragraph 33 of the Procedure for the promotion, exchange, cancellation, transfer, withdrawal, return to the state, invalidation and cancellation of the certificate on temporary residence.

Due to the changes, foreigners and stateless persons (except for citizens of the state, recognized by the Verkhovna Rada of Ukraine as an aggressor) who, in accordance with the laws and international treaties of Ukraine, are not obliged to obtain a long-term visa for the issuance of a temporary residence permit and have received permission to use the work of foreigners and stateless persons not later than 30 days from the date of the last entry to the territory of Ukraine, have the right to apply for obtaining a certificate without leaving Ukraine beyond the terms of observance referred to in paragraph 17 of this Procedure.

The novel, approved by the Cabinet of Ministers, will promote:
  • reduction of time and financial expenses of foreigners who receive a certificate for temporary residence without a long-term visa, in case of employment in Ukraine;
  • reduction of expenditures of business entities in the field of IT-employing foreigners and stateless persons;
  • creation of favorable conditions for attraction of highly skilled personnel (foreigners) to the IT industry.
Changes to the current order of employment of foreigners were initiated by experts of the IT Ukraine Association and the Office of Effective Regulation. Representatives of the Ukrainian IT industry are looking forward to the elimination of barriers on the way to the employment of foreigners who need a D-type visa to work in Ukraine. Today, this type of visa can not be obtained on the territory of our country, which greatly complicates the procedure of employment of Ukrainian IT companies by professionals from many other countries of the world. The Association and the Office of Effective Regulation for consideration of the relevant Ukrainian authorities have submitted three possible scenarios for solving this problem:
  • Obvious: still allow non-residents to receive a “D” visa on the territory of Ukraine. Such a scenario is practiced, for example, Estonia, Latvia, Spain;
  • Compromise: To issue “D” visas on the territory of Ukraine for citizens of visa-free countries (USA, EU countries, etc.);
  • Digital: to issue a “D” visa electronically – so-called e-visas. This approach is already being implemented by the Ukrainian Foreign Ministry when issuing visas for tourist or business purposes.
Currently, the Ministry of Foreign Affairs of Ukraine has rejected each of the proposed scenarios. However, we hope that the liberalization of the rules of employment of the citizens of the CIS countries – the first bell that all the same changes should be expected and for specialists from other countries.
